SpeedOut Games (referred to as “We”, “Our”, “Us”) is a game and app development studio. SpeedOut Games develops, creates, and provides software, apps, games, support services, and websites (collectively “Services”). These Terms of Service (referred to as “Terms”) constitute a legal agreement between SpeedOut Games and a person who accesses or uses Our Services (such person is referred to as “Users”, “User”, You”, “Your”).

These Terms of Service contain important information about Your rights and obligations in relation to the use of Services. By downloading, accessing, purchasing, or using the Services, You indicate that you have read and You accept these Terms of Service. If You do not agree or accept any of these Terms of Service, You shall discontinue accessing and using Our Services.

 

1. Use of Services

1.1 Eligibility

SpeedOut Games Services are intended for Users above the age threshold to consent to data processing in their region (e.g., 13 in the US, 16 in the EU). However, you must be at least 18 to make purchases. If you are under the age of 18, parental or legal guardian consent is required to make a purchase, and he or she must agree to this Terms of Service.

If you are a parent or guardian and you are aware that your child has provided us with personal information or made a purchase, please contact us so that we will be able to do the necessary actions.

3. Intellectual Property Rights

3.1 SpeedOut Games property rights

The software, games, apps, websites, and other Services provided by SpeedOut Games are protected by the copyright and intellectual property laws of the Czech Republic and the European Union. SpeedOut Games is entitled to all such Services and intellectual property rights. 

Intellectual property also includes (but is not limited to) in-software graphics, text, sound, music visual elements, characters, story, and code. You may not remove, alter or cover any copyright, trademark, or other proprietary rights notices incorporated in or accompanying the Services. You are not allowed to copy or modify Services or any part of Services in any way. You are not allowed to extract or modify the source code of Services or make derivative versions of Services. 

SpeedOut Games reserves the right to terminate Your access to Our Services if You violate Our or third-party intellectual property rights.

3.2 Your content

You are entirely responsible for any content You upload, submit, share, or otherwise provide on or through Our Services. You must ensure that such content does not violate any law, copyright, or other Intellectual Property Rights, and if so, You must either own or have a license to use any such Content. If your Content features individuals other than You, You confirm that You obtained permission from such individuals, or in the case of minor children, You obtained the permission of their parent or legal guardian.

According to the Privacy Policy, Our Services store and process personal information, which You have provided Us. It is solely Your responsibility to keep your Device and access to the Services secure.

The data transmission via wireless and wired networks is not inherently secure. We use the latest technology to protect Your personal information and data against unauthorized access or disclosure. However, We can not guarantee that Your personal information will always remain private when using Our Apps or related Services. You accept all responsibility for such security risks and any damage that may result therefrom.

We suggest keeping Your Device always updated to the latest system version. We recommend that you do not jailbreak or root your Device, which is the process of removing software restrictions and limitations imposed by the official operating system of your device. We also recommend not to install any software nor add-ons for Our Services from unknown sources. Such action could make Your Device vulnerable to malware/viruses/malicious programs, compromise Your Device’s security features and even damage the hardware, which SpeedOut Games will not be responsible and liable for.

 

6. Legal information

6.1 Applicable law

SpeedOut Games Terms of Service are governed by the law of the Czech Republic and are in compliance with the laws of the European Union. The Czech law will be used without regard to or application of conflict of laws rules or principles. The United Nations Convention on Contracts for the International Sale of Goods will not apply.

When you agree to this Terms of Service, you are agreeing to resolve any dispute between You and SpeedOut Games through binding or individual arbitration rather than in court.

6.2 Limitation of liability 

Under no circumstances will SpeedOut Games or its owners, executives, employees, licensors, or other third-parties be liable for any injury or loss or any direct, indirect, special, incidental, exemplary, consequential, or punitive damages, or any damages whatsoever (including damages for injury to person or property, for loss of business, revenue, profits, goodwill, business interruption, loss of business information, loss of privacy, failure to meet any duty, loss of data, or hardware damage) arising out of or in any way related to the use or inability to use Services.

SpeedOut Games will not take responsibility for the app not running properly or not working at all. Our certain Services require an internet connection, and as a result, You may be charged by the internet service provider for the cost of used data. Therefore You are accepting all responsibility for any such charges. You also need to make sure that Your device stays charged – if it runs out of battery and You can not use the device, We will not accept any responsibility.

SpeedOut Games keeps its Terms of Service under regular review in order to keep compliant with the law. We reserve the right to make changes to these Terms of Service anytime. Prior to changes becoming effective, We will notify Users by notice in/on Our Services or by email. However, Users are advised to keep the Terms of Service under regular review in case of any changes.

If You do not agree or accept any changes to these Terms of Service, You shall discontinue accessing and using Our Services. Your continued use of the Services after the Terms of Service has been revised shall mean that You accept the changes to the Terms of Service.
